DECISION and ORDER Upon the foregoing cited papers, the Decision/Order in this motion is as follows:

Petitioner's summary judgment denied. Several triable issues of fact exist which preclude an award of summary judgment. Principal among them is whether the petition was issued by the authorized offices of the corporate Petitioner. Other demands for relief are denied, including, striking Respondent's affirmative defenses, which is most pursuant to a superseding dispositive motion dated 12/4/03, and amending the petition to include all arrears outstanding, with leave for Petitioner to renew its application.
