Itkowitz PLLC Wins $243k Attorneys’ Fee and Expenses in Net Lease / Option to Buy Case

This was a net lease case with an option to buy. Obviously, we have all seen quite a few of these cases, as the market has risen over the last decade. After four years of litigation in the New York Supreme Court Commercial Part, the Itkowitz PLLC client was awarded attorneys’ fees and we were sent to a Judicial Hearing Officer for a computation of the amount of the fee award. Following three days of testimony and substantial post-hearing briefing, the JHO issued a decision and recommendation that our client be awarded an astounding $242,823.02 for legal and architectural expenses and fees incurred in connection with this matter, representing 97% of the amount sought.
